Ignition Interlocks In Phoenix DUI Cases

Will I have to have a breath machine in my vehicle if I get arrested for impaired driving in Maricopa County, Arizona?

Here are the most frequently asked questions about breath test devices in vehicles after Arizona DUI arrests.

Ignition interlock devices are now mandatory after every DUI conviction in Arizona. There are several ways a driver might either be required or permitted to have an ignition interlock device installed.

What is an ignition interlock device?

An interlock device is simply any machine that senses breath alcohol level and renders a motor vehicle immobile.

How do they work?

To start your vehicle, you have to give a breath sample. While driving the device asks for additional alcohol free tests at random periods. If alcohol is detected, your vehicle is disabled..

If I get a Phoenix DUI conviction, how long will I need to have an ignition interlock?

Interlocks after convictions:

The most common and basic way to incur an interlock requirement is by getting any DUI conviction. The following are current as of early 2008:

DUI or .08 DUI (first or second offense): 12 month interlock device requirement

Extreme DUI (first or second offense): 12 month interlock device requirement

Super Extreme DUI (first offense): 18 month interlock device requirement

Super Extreme DUI (second offense): 24 month interlock device requirement

Ignition Interlock Devices After Implied Consent Suspensions:

If you have not had a pervious implied consent (chemical test refusal) suspension in the preceding 84 months (7 years) a special work permit may be obtained after the first 90 days of the suspension if the person agrees to install an interlock device.

Interlocks After Aggravated DUI (Class 6 with a child in the car):

If you are convicted of DUI with a child in the car you will get a three year license revocation. If you don't have any prior DUI convictions, complete an admin per se suspension, and complete alcohol screening and treatment, you may get a permit to drive if you install an interlock after the first 90 days of the suspension.
