Plea Bargains in Phoenix DUI Cases
Dismissing a Phoenix DUI charge without a reason is against the law.
In fact, Arizona DUI law states that the state may not dismiss a DUI charge unless they reasonably lack legal grounds to get a conviction.
What does this mean?
As a general rule Phoenix DUI prosecutors will not plea bargain a case from a DUI to less serious offense unless there is something wrong with the case.
What it means without an attorney.
Without an attorney representing you in your Phoenix DUI matter, a prosecutor has very little chance of losing the case. Because they are not afraid of losing to an unrepresented person, the chances of a favorable plea bargain or dismissal may be lessened.
Can a Phoenix DUI attorney get me a better deal than I can get for myself?
The answer depends on the attorney. A lawyer who never goes to trial almost always pleas his/her client guilty is not a threat to prosecutors, and therefore provides little additional incentive for a prosecutor to offer a deal. On the other hand, an attorney with a reputation as a steady and worthy advocate often times will secure much better deals for people than they could get for themselves.
