Originally admitted to the practice of law in 1992, he began his career in the prosecutor's office, where he gained early experience. As a Deputy District Attorney, Mr. Bergman was responsible for prosecuting vehicular crimes. This included DUI cases and prosecutions regarding impairment and reckless operation of motor vehicles. As a part of his duties, Mr. Bergman trained police officers in administering field sobriety tests and educated them about proper searches and seizures of evidence in the field.
Stewart has been a defense lawyer since 2000.
He has worked as a Maricopa County Deputy Public Defender, in the vehicular crimes bureau, handling a complex felony cases ranging from Phoenix area felony DUI to vehicular assaults and Manslaughter cases.
While advocating for his clients in thousands of cases in Maricopa County, Mr. Bergman gained invaluable training and experience in every issue that may arise in a DUI case up to and including vehicular homicide cases. He was instrumental in having an aggravated assault case (a crash involving the accused driver being impaired and causing injury to another driver), dismissed after he successfully argued the statute (A.R.S. 28-673), relied upon by the State for introducing the defendant’s blood sample, was unconstitutional.
After his tenure in the vehicular bureau, he went into private practice where he handles a wide range of vehicular offenses in the Phoenix area, ranging from basic first-offense misdemeanor DUI charges to serious felonies, as well as other criminal matters.
